What Happens When the Court Awards Attorney's Fees

In some proceedings, the judge may award attorneys fees. There are various factors that go into the decision, and there is never a guarantee that the judge WILL award the fees. In any case, you must first pay your attorney. If the court awards the fees, the other party will pay the attorney, and the attorney can reimburse you unless you still owe.

Before you hire an attorney, you should talk to him or her about how they handle this process and what will be expected should the judge award fees. Just know that in most (if not all) family law cases, YOU will pay your attorney first.
